คณะรัฐมนตรีแถลงนโยบาย เร่งรัดการจดทะเบียนแรงงานต่างด้าวรอบใหม่ ช่วยแก้ไขปัญหาการขาดแคลนแรงงานในระดับล่าง แต่ต้องอยู่ภายใต้ความสมดุลระหว่างการรักษาความมั่นคงภายใน และสิทธิมนุษยชน

นายพิชัย เอกพิทักษ์ดำรง อธิบดีกรมการจัดหางาน เปิดเผยว่า จากการสำรวจความต้องการของกรมการจัดหางานพบว่า นายจ้าง/สถานประกอบการต้องการจ้างแรงงานต่างด้าวทั้งสิ้น 1,312,170 คน จากมติคณะรัฐมนตรีเมื่อวันที่ 18 ธันวาคม 2550 มีแรงงานต่างด้าวมาจดทะเบียนและต่ออายุใบอนุญาตทำงาน จำนวน 501,570 คน ซึ่งยังมีความต้องการแรงงานอยู่อีก 810,600 คน ทางกรมการจัดหางานได้ดำเนินการเร่งพิสูจน์สัญชาติ และนำเข้าแรงงานต่างด้าวตาม MOU แต่ก็ยังไม่เพียงพอและยังมีความล่าช้า ดังนั้นเพื่อเป็นการแก้ไขปัญหาดังกล่าว จึงได้เสนอให้มีการเปิดจดทะเบียน แรงงานต่างด้าวรอบใหม่ ภายใต้ความสมดุลระหว่างการรักษาความมั่นคงภายใน การดูแลสิทธิมนุษยชนขั้นพื้นฐาน ซึ่งสาระสำคัญของการเสนอขอเปิดจดทะเบียนแรงงานต่างด้าวรอบใหม่ 1. เพื่อให้นายจ้างมีความรับผิดชอบต่อการจ้างแรงงานต่างด้าวโดยนายจ้างต้อง รายงานการ คงอยู่ของแรงงานต่างด้าว ทุก 3 เดือน หรือเมื่อมีการเลิกจ้าง และหากนายจ้างประสงค์จะจ้างแรงงานต่างด้าวต่อให้นำตัวไปพิสูจน์สัญชาติให้ แล้วเสร็จ (เนื่องจากจะไม่ต่ออายุใบอนุญาตทำงานเมื่อครบกำหนดวันที่ 28 กุมภาพันธ์ 2553) 2. แรงงานต่างด้าวที่ได้รับใบอนุญาตทำงานแล้ว จะเปลี่ยนนายจ้างไม่ได้ เว้นแต่มีเหตุจำเป็น เช่น ถูกนายจ้างทารุณกรรม นายจ้างตาย นายจ้างเลิกกิจการ หรือไม่ปฏิบัติตามกฎหมายคุ้มครองแรงงาน โดยให้เวลาแรงงานต่างด้าว 7 วัน ดำเนินการหานาย จ้างใหม่ หากไม่สามารถหานายจ้างได้ภายในกำหนดระยะเวลาจะต้องถูกส่งกลับ และเดินทางกลับเข้ามาใหม่อย่างถูกต้องตามกฎหมาย 3. ให้จังหวัด และหน่วยงานที่เกี่ยวข้องร่วมกับหน่วยงานภายในจังหวัดร่วมกันดำเนินการจัด ตั้งศูนย์คุ้มครองสิทธิประโยชน์แก่แรงงาน ต่างด้าว ที่อยู่ในระบบ เพื่อคุ้มครองแรงงานให้ได้รับการปฏิบัติอย่างเป็นธรรมจากนายจ้าง และกฎหมายคุ้มครองแรงงาน ซึ่งขณะนี้นโยบายดังกล่าวอยู่ระหว่างการรอเสนอความคิดเห็นต่อคณะกรรมการ บริหารแรงงานต่างด้าวหลบหนีเข้าเมือง (กบร.) เพื่อเสนอคณะรัฐมนตรีพิจารณาต่อไป

A 16-year old Burmese migrant worker survived with help from people when she regained consciousness in a bush after a gang in Samut Sakhon Province Southern Thailand raped her for four days and beat her up.

A cotton factory worker, she was hospitalized.  She was taken away by the gang who worked at the same factory on June 22. She claimed that she was raped by two Thai men and a Burmese.

She is being treated at Samut Sakhon hospital since Thursday, June 26 after the leader of workers found her in a bush inside the factory compound which is about 100 acres, according to her relative Nai Pi Ya Mon.

She was severely beaten on the head and other parts of body by the gang who wanted to kill her after torturing and raping her to hide evidence.

“She will be operated in her mouth in the hospital. Three of her teeth were broken and she cannot eat food properly because of wounds in her mouth,” her relative said.

Her mother cried her heart out but was happy because her daughter was alive.

She arrived in Thailand over a year ago and was staying with her mother. She is from Thanpyuzayart Township , Mon State .

“She disappeared on the evening of June 22 after two Thai men and a Burmese man asked her to eat some snacks but she refused. They forcibly fed her and she fell unconscious,” according to her relative.

According to the Women and Child Rights Project based in Thailand , the same thing happened to a Karen girl the same week.

เตรียมเปิดจดทะเบียนแรงงานต่างด้าวรอบสุดท้ายเดือน พ.ย.นี้

ก.แรงงาน 11 ก.ย.- ไทยบรรลุข้อตกลงพม่ากำหนดจุดพิสูจน์สัญชาติแรงงานต่างด้าวพม่าตามแนวชายแดนใน 3 จุด สามารถดำเนินการได้ตั้งแต่ต้นเดือนหน้า ขณะที่กรมการจัดหางานเตรียมเปิดจดทะเบียนแรงงานต่างด้าวรอบสุดท้ายให้เฉพาะตัวแรงงานเท่านั้น คาดเริ่มจดทะเบียนได้ช่วงเดือน พ.ย.นี้

นายไพโรจน์ สุขสัมฤทธิ์ อธิบดีกรมการจัดหางาน กล่าวว่า วันนี้ที่ประชุมคณะอนุกรรมการอำนวยการบริหารแรงงานต่างด้าวทั้งระบบได้พิจารณาเรื่องสำคัญ 2 เรื่อง คือ 1.การพิสูจน์สัญชาติแรงงานต่างด้าวสัญชาติพม่า ซึ่งทางคณะทำงานเร่งรัดการจดทะเบียนแรงงานต่างด้าวได้บรรลุข้อตกลงกับทางการพม่าในการกำหนดจุดพิสูจน์สัญชาติแรงงานต่างด้าวพม่าที่มีประมาณ 500,000 คน ใน 3 จุด คือที่ เกาะสอง ตรงข้าม จ.ระนอง เมืองเมียวดี ตรงข้าม อ.แม่สอด จ.ตาก และ ท่าขี้เหล็ก ตรงข้าม อ.แม่สาย จ.เชียงราย หากนายจ้างมีลูกจ้างพม่าที่จดทะเบียนถูกต้องแล้วสามารถนำไปพิสูจน์สัญชาติได้ตั้งแต่เดือน ต.ค.นี้เป็นต้นไป

2. เรื่องการเปิดจดทะเบียนแรงงานต่างด้าวหลบหนีเข้าเมืองรอบใหม่ ทางคณะอนุกรรมการฯ เห็นชอบให้มีการจดทะเบียนแรงงานต่างด้าวรอบใหม่ และเป็นรอบสุดท้าย ซึ่งจะมีการเสนอคณะรัฐมนตรี (ครม.) เห็นชอบปลายเดือนนี้ คาดจะสามารถดำเนินการจดทะเบียนได้ในเดือน พ.ย. หรือ ธ.ค.ปีนี้ โดยการจดทะเบียนรอบใหม่จะให้จดทะเบียนเฉพาะตัวแรงงานต่างด้าวเท่านั้น บุตรและผู้ติดตามจะมอบให้หน่วยงานที่เกี่ยวข้องรับไปดำเนินการว่าจะจัดหาที่อยู่หรือผลักดันออกไป สำหรับระยะเวลาการจดทะเบียนจะกำหนด 30 วัน หลัง ครม.มีมติเห็นชอบ ยกเว้น กิจการประมง และแรงงานใน 5 จ.ชายแดนใต้ คือ ยะลา นราธิวาส ปัตตานี สตูล และสงขลา ที่สามารถผ่อนผันวันจดทะเบียนออกไป

“ขอย้ำว่ารอบนี้เป็นรอบสุดท้ายจริง ๆ ต่อไปนี้ แรงงานต่างด้าวจะเข้ามาจะต้องนำเข้าอย่างถูกกฎหมาย และระหว่างนี้ฝ่ายความมั่นคงจะเข้มงวดเรื่องการหลบหนีเข้าเมืองตามชายแดน จึงขอแจ้งเจ้าของสถานประกอบการให้ทราบ ขณะนี้ระบบการนำเข้าแรงงานต่างด้าวอย่างถูกต้องเสร็จเรียบร้อยแล้ว คาดว่าจะช่วยแก้ปัญหาแรงงานเถื่อนให้หมดไป” นายไพโรจน์กล่าวและว่า ต่อไปนี้นายจ้างที่ต้องการแรงงานต่างด้าวสามารถแจ้งโควตาความต้องการมายังสำนักงานจัดหางานจังหวัด จากนั้นทางกระทรวงแรงงานจะประสานไปยังประเทศที่แรงงานต่างด้าวสังกัดผ่านกระทรวงการต่างประเทศ เมื่อได้แรงงานแล้ว ก็นัดนายจ้างรับแรงงานได้ตามจุดที่กำหนดต่อไปเชื่อว่าปัญหาแรงงานเถื่อนจะหมดไป

นายไพโรจน์ กล่าวต่อว่า สำหรับยอดแรงงานที่จดทะเบียนในรอบนี้น่าจะมีประมาณ 700,000 คน ส่วนการจดทะเบียนจะอำนวยการความสะดวกแก่นายจ้างมากขึ้น ลดขั้นตอนและค่าธรรมเนียม ที่ผ่านมากว่าลูกจ้างจะได้บัตรแรงงานต่างด้าวใช้เวลานานมาก แต่ขั้นตอนใหม่จะใช้เวลาวันเดียวหลังจากตรวจโรคแล้ว อย่างไรก็ตาม ที่ประชุมมีความกังวลเรื่องปัญหาการปลอมบัตร แต่เชื่อว่าระบบการตรวจสอบที่ดำเนินการไว้จะทำให้ปลอมบัตรได้ยาก.-สำนักข่าวไทย

กรมจัดหางานเตือนนายจ้างระวังแรงงานเขมรคลั่งชาติก่อเหตุร้าย ช่วงเกิดข้อพิพาทไทย-กัมพูชา

นายวสันต์ สาทร ผู้อำนวยการบริหารแรงงานต่างด้าว กรมการจัดหางาน กระทรวงแรงงาน เปิดเผยว่า เพื่อความไม่ประมาท ได้ทำหนังสือถึงผู้ประกอบการไทยทุกแห่ง ที่รับแรงงานต่างด้าวเข้าทำงานให้ระวังแรงงานกัมพูชาที่อาจเกิดกระแสคลั่งชาติก่อเหตุร้าย ซึ่งเป็นผลมาจากเหตุการณ์ปะทะกันระหว่างทหารไทย-กัมพูชาบริเวณแนวชายแดน

ทั้งนี้ ยังไม่ได้รับแจ้งเหตุผิดปกติจากนายจ้างไทย แต่ก็ได้ติดตามสถานการณ์อย่างใกล้ชิด อย่างไรก็ตามมีแรงงาน ต่างด้าวขึ้นทะเบียนอย่างถูกต้อง 6.9 หมื่นคน และคาดว่ามีแรงงานที่ลักลอบหลบหนีเข้าเมืองกว่า 3 หมื่นคน

อย่างไรก็ตาม กทม.จัดว่ามีแรงงาน ต่างด้าวชาวกัมพูชามาทำงานมากที่สุด รองลงมาคือ จ.ตราด และจันทบุรี โดยอาชีพที่แรงงานกัมพูชานิยมทำมากที่สุดคือรับจ้างเป็นแรงงานในการแบกของ ในโรงงานอุตสาหกรรม รองลงมาคือประมง และเกษตรกรรม โดยพื้นที่เหล่านี้จะต้องเพิ่มความระมัดระวังมากยิ่งขึ้นในช่วงนี้

ด้าน น.ส.วัชรินทร์ ยงศิริ นักวิจัยด้านการค้าชายแดนไทย-กัมพูชา สถาบันเอเชียศึกษา จุฬาลงกรณ์มหาวิทยาลัย กล่าวว่า การปลุกระแสชาตินิยมมาเกี่ยวกับปัญหาพิพาทชายแดนกัมพูชา จะส่งผลกระทบ ต่อกิจการการลงทุนของผู้ประกอบการ ในไทย เพราะช่วงขึ้นทะเบียนปราสาท พระวิหารเป็นมรดกโลก เมื่อเดือน ก.ค. มีการส่งข้อความสั้นไปทั่วกัมพูชาให้ต่อต้านสินค้าไทย

“ครั้งนี้มีการสู้รบปะทะกันในพื้นที่พิพาท ยิ่งมีการปลุกระดมได้ง่ายยิ่งขึ้น และจะมีการรณรงค์ต่อต้านสินค้าไทยให้โหมรุนแรงออกไปอีก โดยเฉพาะธุรกิจด้านเครื่องอุปโภค บริโภค ไม่ว่าจะเป็นผงซักฟอก สบู่ ยาสีฟัน ของใช้ในครัวเรือน ฯลฯ ที่กัมพูชานำเข้าจากไทยมากที่สุด นอกจากนั้นธุรกิจการโรงแรมก็เสี่ยงต่อการบุกทำลาย ผู้ประกอบการไทยควรระมัดระวังและเตรียมการป้องกันให้พร้อมทุกด้าน” น.ส.วัชรินทร์ กล่าว

ขณะที่นายยุทธศักดิ์ สุภสร ผู้อำนวยการสถาบันอาหาร กล่าวว่า หากสถานการณ์ ความขัดแย้งยังยืดเยื้อและยังมีความรุนแรง จะส่งผลกระทบต่อการค้าระหว่างไทยและกัมพูชาในช่วงปลายปี โดยเฉพาะกลุ่มเครื่องดื่มแอลกอฮอล์ เนื่องจากเป็นช่วงเทศกาล จะมีการนำเข้าเครื่องดื่มแอลกอฮอล์ ค่อนข้างมาก อาจทำให้ไทยเสียโอกาสทางการค้าได้

ทั้งนี้ ช่วงเดือน ม.ค.-ส.ค. ปี 2551 ส่งออกแอลกอฮอล์ 3.69 หมื่นตัน มูลค่า 1,438 ล้านบาท เพิ่มขึ้นจากช่วงเดียวกันของปี 2550 ในแง่ปริมาณ 49% และเชิงมูลค่า 40% โดยในปี 2550 ส่งออกไปปริมาณ 2.48 หมื่นตัน คิดเป็นมูลค่า 1,025 ล้านบาท ยอดส่งออกที่เพิ่มขึ้น แสดงให้เห็นว่าสินค้าไทยยังได้รับความนิยมจากของลูกค้าชาวกัมพูชา

Save the Rohingya refugees in Thailand

Prime Minister Samak Sundaravej said after emerging from a two-hour meeting of the National Security Council on March 28 that the Royal Thai Navy is looking for a deserted island to place the Rohingya refugees currently living in Thailand.

He expressed his intention to show the Rohingyas that ”life here [in Thailand] will be difficult”. He did not provide any proof of wrongdoing or crime the Rohingyas may have committed here, for which he has decided to banish this ethnic community to a deserted isle.

After denying the right of Rohingyas to citizenship in Burma and conducting genocidal operations against us, Burma’s military rulers have turned the Rohingya into a stateless sub-human community, denying us our right to live in Arakan, where we have been living for centuries in peace. Today, uprooted from Arakan, over 1.5 million Rohingyas are roaming in different countries as gypsy human beings.

Now the Thai prime minister wants to fulfil the unmet wish of Burma’s ruling gen erals (to kill those hapless Rohingyas who escaped their clutches), by deporting them to a solitary island where possibly either the Thai forces or the Burmese army will be able to massacre them beyond the notice of the international community.

The Thai prime minister says Westerners are overly critical of Burma and he has found new respect for the ruling generals after learning that they meditate like good Buddhists.

He is thus conniving in the series of atrocities the Burmese junta are commiting, even against revered Buddhist monks.

On March 25, the Thai army raided Burmese opposition groups in Mae Sot. They raided the homes of three Karen National Union leaders and the office of one Burmese student group. Many exiled groups and community organisations in Mae Sot have closed their offices for security reasons.

The prime minister’s statement has sent waves of shock and grief throughout the Rohingya community. Through decades-long political oppression, economic exploitation, social degradation and cultural slavery, Burma’s military rulers have turned the Rohingyas into a powerless, defenceless and voiceless, crippled community.

Rohingyas have been crying in the corner and dying in silence for decades. Now, if the international community will not come forward to save us from deportation to this ”island of death”, it will add another notch to the scale of tyranny being committed against the Rohingyas.

Therefore, to draw international attention, we, the 1.5 million Rohingya men, women and children in exile, will resort to a hunger strike until death at the premises of the United Nations missions around the world, to save our Rohingya brethren in Thailand.

We also appeal to the people of Thailand and Thai human rights groups, to understand our plight and come forward to prevail upon their prime minister to withdraw his decision.

Today, being uprooted from our own motherland, over 1.5 million Rohingyas are roaming in different countries of the world as statusless gypsy human beings.

Today, the Thai Prime Minister wants to fulfill the unmet wish of Burma ‘s ruling generals to kill those hapless Rohingyas who escaped from their paws, through deporting them to the solitary island where either the Thai forces or the Burmese army will be able to massacre the Rohingyas beyond the notice of the internaitonal community.

The Thai Prime Minister said,”We want electricity. Burma has allowed us to build a dam. We want to sell goods there. Burma will build a port. Is that not good for Thailand ?”. So, in order to build up a celestial empire, the Thai Prime Minister wants to offer the innocent Rohingyas as the requiem in the altar of tryanny of Burma ‘s military rulers by sending them to the island of Death where if the Thai forces can place the Rohingyas today, then tomorrow the Burmese forces will land in that island and thus massacre the entire Rohingya men, women and children.

Now, if the international community will not come forward to save the Rohingyas from deportation to the island of death by the Thai Prime Minister, it will just add another notch of genocide in the scale of man-made tragedies of Rohingyas.

However, we the 1.5 million Rohingyas in exile will not become the silent spectator of the episode of genocide of our Rohingya brothers, our sisters and our children in Thailand . We will cry through all democratic means to protest the inhuman decision of the Thai Prime Minister. And if necessary, to draw the international attention, we the 1.5 million Rohingya men, women and children in exile will resort to hunger strike until death at the premises of the UN missions and offices of other World Bodies to save our Rohingya brothers, our sisters and our children in Thailand.

At the sametime, we fervently appeal to international humanitarian community, the World Bodies, human rights groups and the news media to come forward to save the Rohingya refugee community in Thailand . We also appeal to the people of Thailand , its human rights groups as well as its journalist society to understand our plight and come forward to prevail upon their Prime Minister to withdraw his decision.

Plight of Moken on Kho Lao, Ranong

Koh Lao is a small island in the Andaman Sea on the Thai-Myanmar border. It is home to some three hundred Moken people.

One of the most common sights for the Moken women and children is to see their husbands or fathers embarking on a sea trip which sometimes lasts from three weeks to a month.

They sail down to the Nicobar Islands in Indonesia, where they dive for sea cucumbers.

Some of them are arrested by Indonesian authorities while others come back with crippled legs as a result of decompression sickness. Many of them even do not return to their beloved families.

Taeloy Pramongkij said he had no choice, because the fishery sector in Ranong was becoming difficult.

” Of course, we are afraid of being handicapped or dead. But if we stay here, we night die of starvation. We have to take all the risks. “, said Taeloy.

His family has been living on the island for over 30 years. In recent years, representatives of a number of state agencies and non government organizations came to the island, trying to improve their living conditions. But a concrete development plan has yet to be seen.

Meanwhile, other Moken communities in other parts of the Andaman Sea have received much support such as vocational training or turning their fishing village into a tourist attraction. Some of them are even granted Thai citizenship.

” Moken have been living in Thailand for generations. Some of them enjoy a certain degree of legal recognition. But why are the Moken on Koh Lao barred from official household registration? said NGO worker, Naovanit Jaempit.

Thai police: shamelessly bizarre

Fifty-four people have perished in a horrific example of human trafficking in Ranong. But the police are refusing to touch the human smuggling ring. Guess why? Harsh poverty and political oppression are not the only principal factors for this endless influx of migrant workers from Burma. Equally important is our internal ills. Guess what? Call it state complicity. Call it systemic corruption. Call it heartlessness. Whatever we call it, they are the reasons why this hideous modern slave trade is thriving non-stop in our so-called Buddhist land.
The Ranong tragedy is a case in point. Had it not been for the fatal breakdown in the ventilation system, the cold storage truck that was ferrying 121 workers would have made a safe trip to its destination in Phuket, as it had done countless times before. The local police would have been able to continue pretending – as they always have – that they know nothing about the blatant trade in human beings that is being carried out practically every day right before their eyes.
Though the police cannot now feign blindness to the Ranong tragedy, it is interesting to see how they have reacted in order to protect the hand that feeds them. No, not us taxpayers. Guess who?
If a case is registered as human trafficking, the migrant workers must be treated as victims entitled to state help and compensation. They must also be protected as witnesses so that the authorities can go after the masterminds and those involved in the human trade.
But the police fiercely insist that the Ranong tragedy is not a case of human trafficking, because the workers had not been “lured or forced” to come to Thailand. In addition, the workers were “on the way, without a destination”. Therefore they may not be defined as slave labour. As such, the case can only be processed as one of illegal entry into the country, which means these Burmese migrants must be arrested, fined and deported immediately.
These excuses are maddening not only because they are absurd, but also because they show how the police view us – as nothing less than perfect fools.
How on earth can the police know that the workers were not lured or forced? How does the police define consent?
According to the United Nations’ definition, trafficking in persons covers the recruitment, transportation, transfer, harbouring or receipts of persons by different means, be it through threats, use of force, coercion, abuse of power, or promise of future benefits. Consent is irrelevant when money changes hands for the purpose of exploitation.

It is the police’s narrow, self-serving definition of human trafficking that has made Thailand a hub in the smuggling of humans in the region.
Thailand’s promises to the international community to combat human trafficking are empty because the police refuse to change their ways. And why should they? Last month, Prime Minister Samak Sundaravej suggested an innovative way to discourage the migration of ethnic Muslims from Burma into Thailand: round them up and leave them on a deserted island.
